HANLAN BOAT CLUB - Membership Application, Member Agreement and Waiver of Liability (last updated February 2022)

This application, agreement and waiver of liability (“Agreement”) must be completed by all members at the time of registration

  1. I provide this Agreement on my own behalf or as parent or guardian of a rower under the age of 18 years.

  2.  I have read and agree to be bound by

    a. this Agreement;

    b. the Club’s Bylaws; and

    c. the rules, policies, codes of conduct, procedures, manuals and training materials of Hanlan Boat Club, including any updates or amendments to these materials.  I will review notices from the Club and monitor the Club’s website (Policies page) for any updates or amendments.       

  3. Without limiting my obligations under sections 1 and 2 of this agreement, I have read and will abide by the Hanlan Boat Club Safety Policy, Volunteer Policy, Boat Damage and Boat Usage Policies, Regatta Fees Policies, Harassment Policy, Workplace Harassment and Violence Prevention Policies, and all Rowing Canada Aviron (RCA) Safe Sport Policies.

  4. I will pay my fees in full (including regatta fees) and understand that my membership may be denied, suspended or terminated if I have unpaid fees. I understand that my fees are non-refundable, except in accordance with the Club’s refund policies.

  5. I confirm that

    a. I can swim and will submit to a swimming test if required by the club;

    b. I am in good health and medically fit to engage in the sport of rowing and do not suffer from a heart condition or other ailment that could be exacerbated by exertion;

  6. I am responsible for

    a. ensuring the working condition and good repair of any boat or other equipment (e.g., rowing machines, oars) I use, including the adequate provision of approved safety equipment as outlined in Transport Canada’s Safe Boating Guide;

    b. my personal safety and the welfare of others on the water, on Hanlan property or at the boathouse, and when using property, vehicles or other equipment pertaining to the club, including the grounds, boathouse, utilities, trailers, vehicles, shoreline and docks;

    c. providing myself with an approved life jacket and other personal safety equipment (unless otherwise the explicit responsibility of my program or coach); 

    d. complying with all applicable laws, by-laws and rules of RowOntario, Rowing Canada Aviron (RCA), and of any federal, provincial or municipal authority such as the Toronto Police Marine Unit;

  7. I consent to the collection, use and disclosure of my personal information in accordance with the Club’s Privacy Policy.

  8. I have reviewed the ROWONTARIO Concussion Resources (https://www.rowontario.ca/concussion-management/) and the Hanlan Concussion Management Policy; and I acknowledge and commit to the ROWONTARIO Concussion Code of Conduct (Athlete) at https://www.rowontario.ca/uploads/2019/11/RO-Concussion-CoC-Athlete.pdf). 

  9.  I understand that Hanlan Boat Club is run primarily by volunteers in order to manage costs. I will volunteer for the following committee or work crew (in the case of junior athletes, either the athlete or the parent will volunteer).   10. WAIVER OF LIABILITY AND ASSUMPTION OF RISKS  - I understand that rowing includes activities both on land and on the water that involve certain risks and dangers.  I understand that the risks include, but are not limited to, injury from collision with another vessel or stationary objects and from the malfunctioning of equipment and injury or drowning as a result of capsizing or being swamped by waves from passing vessels or adverse weather. Such risks are increased when the air or water temperature is low creating the risk of hypothermia. I also understand that the physical exertion of rowing, including carrying boats in and out of the water, can result in injury or death.   I understand that the inherent nature of being around the water and boats has risks such as slippery docks.

I also understand that I (or my child) may contract COVID-19 while participating in rowing activities at Hanlan Boat Club. 

In consideration of Hanlan Boat Club, RCA and RowOntario agreeing to allow me (or my child, if under 18) to participate in rowing, accompanied or unaccompanied (meaning with or without a safety/coach boat), employing the club’s or private equipment, and permitting my use of club facilities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree to not hold the club, its directors, officers, employees, agents, coaches, instructors, volunteers, independent contractors, subcontractors and representatives, or those of RCA (all of whom are hereinafter referred to as the “Releasees”) liable for my personal injury, illness, death and/or property loss, and; TO WAIVE ANY AND ALL CLAIMS THAT I HAVE OR MAY HAVE IN THE FUTURE AGAINST THE RELEASEES AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my next of kin may suffer as a result of my participation in the Rowing Activities, on land or on water, due to any cause whatsoever, including NEGLIGENCE, BREACH OF CONTRACT, BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE INCLUDING ANY DUTY OF CARE UNDER THE OCCUPIERS LIABILITY ACT ON THE PART OF THE RELEASEES AND FURTHER, INCLUDING FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD AND PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF THE ROWING ACTIVITIES REFERRED TO ABOVE.

I agree to hold harmless and to indemnify the Releasees from any and all liability for any property damage or personal injury to any third party resulting from my participation in rowing. It is my intention that this agreement will bind my heirs, next of kin, executors, administrators and assigns in the event of my death. In entering into this agreement I am not relying on any oral or written representation or statements made by the Releasees with respect to the safety of the Rowing Activities other than as set forth in this agreement.

By accepting this waiver, I acknowledge (on my own behalf, or as parent/guardian on behalf of a participant under the age of 18 years old) that I have read and understood this agreement, and that I am aware that by doing so I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators and assigns may have against the Releasees.
